Evaluation of firms

Purpose

Keeping in mind that there are limitation on the number of firms to which the invitation to tender should be sent depending on the estimated amount of the future contract, the evaluation of firms aims to select the firms that will receive the Invitation to Tender.

Disqualification of firms at the Market Survey stage is a sensible issue for delegates during Finance Committee. As a result, the Department Head shall be informed and involved at all stages of the procurement process to be able to give accurate answers.

Procedure

Once the Market Survey deadline (in principle 4 weeks) is exceeded, the technical responsible shall evaluate the answers received.

It is to the discretion of the technical responsible to select the firms that shall be visited.

The technical responsible shall take advantage of the Market Survey stage to discuss any point with potential Bidders. It should be noted that any informal contact with Bidders will be prohibited once the Invitation to Tender has been sent out.

In case of disqualification of firms, the technical responsible shall prepare a memorandum indicating the disqualified firms and the reason for disqualification, explaining which points of the Qualification Criteria were not met. This memorandum shall be discussed with the EN Specification Review Panel before distribution outside the Department.

At the Market Survey stage, a firm can be disqualified only if Qualification Criteria are proven not to be met by the firm.
Disqualification of firms at the Market Survey stage is a key issue during Finance Committee. As a result, the reasons for disqualification shall be verified by the EN Specification Review Panel in order to check that they are defendable towards delegates.
